1. Agreement to Terms

This agreement ("Terms”) is a legally binding contract between you ("User”, "Customer”, "Buyer”, "Renter”, or "you”) and KaziSupply ("we”, "our”, or "us”), an online marketplace platform for equipment rental, equipment sales, building materials, and construction supplies.

By accessing, browsing, or using KaziSupply through any means — including our website, mobile applications, or related services — you acknowledge that you have read, understood, and agreed to be bound by these Terms & Conditions, together with our Privacy Policy.

If you do not agree to these Terms, you must immediately discontinue use of the platform.

These Terms apply to all users accessing KaziSupply in the Republic of Zambia, the United Republic of Tanzania, and any other jurisdiction where we operate.

2. About KaziSupply

KaziSupply is a multi-vendor marketplace platform connecting businesses and individuals with suppliers of:

• Construction Equipment: Excavators, bulldozers, cranes, forklifts, scaffolding, concrete mixers

• Power Tools: Drills, saws, grinders, compressors, welding equipment

• Building Materials: Cement, steel, bricks, roofing, paint, lumber, plumbing, electrical supplies

• Automotive Parts: Vehicle components, repair tools, diagnostic equipment

• Safety Equipment: Helmets, harnesses, protective gear, first aid supplies

• Utility Vehicles: Small trucks, canters, dump trucks, tippers, trailers, delivery vehicles

• Generators & Power: Diesel generators, petrol generators, inverter generators, portable power units

• Agricultural Equipment: Tractors, plows, harvesters, irrigation systems, sprayers, tillers

2.1 Platform Services

Through KaziSupply, users may:

• Rent Equipment: Book tools and machinery for daily, weekly, or monthly rental periods

• Buy Equipment: Purchase new or used tools, machinery, and equipment

• Buy Materials: Order construction supplies, building materials, and consumables

• Sell Equipment: List equipment and materials for sale as a Vendor

• Compare & Review: Compare products, read reviews, and make informed decisions

2.2 Platform Role & Limitations

KaziSupply operates solely as a technology platform and marketplace facilitator. We:

• Do not own, manufacture, warehouse, or physically handle products listed on the platform

• Do not control, inspect, test, or warrant product quality, safety, condition, or authenticity

• Are not a party to sale or rental contracts between Vendors and Customers

• Are not responsible for delivery, installation, training, maintenance, or warranties

• Do not guarantee equipment availability, functionality, or suitability for any purpose

• Are not liable for damage, loss, injury, death, or property damage arising from equipment use

All sale and rental agreements are formed directly between Vendors and Customers. KaziSupply provides marketplace infrastructure, payment processing, and communication tools only.

3. Equipment Rental Terms

IMPORTANT: The following terms constitute a legally binding rental contract. Renters assume full responsibility and liability for rented equipment from the moment of pickup or delivery acceptance until satisfactory return.

3.1 Rental Agreement Formation

When a Customer books equipment through KaziSupply:

• A legally binding rental contract is formed directly between the Vendor and the Renter

• The contract includes equipment identification, rental period, rental rate, security deposit, delivery/pickup arrangements, and usage terms

• Both parties must comply with the rental listing, booking confirmation, and these Terms

• KaziSupply is not a party to the rental contract and assumes no liability

3.2 Rental Periods and Extensions

• Rental periods begin at the exact time of pickup or delivery acceptance

• Rental periods end at the agreed return date and time

• Late returns incur additional charges and applicable penalties

• Rental extensions must be requested at least 24 hours in advance and approved by the Vendor

• Unauthorized retention may be treated as theft and reported to law enforcement

• Vendors may charge full daily rates and recovery costs for overdue equipment

4. Insurance Requirements and Liability

CRITICAL NOTICE: Renters bear ABSOLUTE LIABILITY for equipment damage, loss, or theft. Insurance is MANDATORY for rentals exceeding USD 500.

4.1 Mandatory Insurance for High-Value Rentals

For rentals exceeding USD 500 (or equivalent in ZMW/TZS):

• Renters must maintain comprehensive all-risk equipment insurance

• Proof of insurance must be provided before pickup

• Coverage must equal 100% of the equipment’s replacement value

• Insurance must remain valid throughout the rental period

• Failure to maintain insurance constitutes a material breach

4.2 Renter Absolute Liability

Renters are fully and unconditionally liable for:

• Physical damage of any kind

• Theft or loss, including administrative and investigation costs

• Fire damage, regardless of cause

• Water damage, flooding, corrosion, or moisture exposure

• Collision or rollover damage

• Missing components or accessories

• Loss of use during repair or replacement

• Environmental damage, cleanup, and regulatory fines

5. Property Damage and Third-Party Liability

CRITICAL: Renters are solely and exclusively responsible for all property damage, personal injury, or death caused by rental equipment.

5.2 Fire and Explosion Liability

Renters assume TOTAL and UNCONDITIONAL liability for:

• Damage to buildings, structures, vehicles, and property

• Personal injury, burns, smoke inhalation, or death

• Environmental damage and fire spread

• Emergency response and evacuation costs

• Business interruption and economic losses

• Legal defense costs, judgments, and settlements

This liability applies regardless of the cause of the fire, including equipment defects, operator error, electrical faults, fuel ignition, environmental factors, or third-party actions.

KAZISUPPLY AND VENDORS EXPRESSLY DISCLAIM ALL LIABILITY FOR FIRE-RELATED DAMAGES UNDER ALL CIRCUMSTANCES.
